The premium processing of some categories of green cards and visa applicants, especially those related to international students, will be expanded, as the Biden Administration has revealed.
The measure would be carried out in phases, with premium processing of EB-1 and EB-2 applications for Green cards being given priority. The new changes will be added to all previously submitted Form I-140 petitions under an E13 multinational executive and manager classification, VisaGuide.World reports.
More specifically, EB-1 refers to employment-based immigration, with the eligibility criteria for this visa being proof of ability in sciences, arts, education, business, or for athletic skills recognized at the national level. In addition, those that can demonstrate international recognition for achievements in academic fields can be eligible to apply for this visa.
EB-2 also refers to immigration based on immigration for employment, and all those that have an advanced degree within the required criteria can apply for this visa.
“You must be able to show exceptional ability in the sciences, arts, or business. Exceptional ability “means a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business,” the US Citizenship and Immigration Services explains.
Furthermore, E21 classification as a member of professions with higher level degrees or exceptional ability while seeking a National Interest Waiver (NIW), as the US Citizenship and Immigration Services (USCIS) said.
The authority said the new changes are part of the efforts to have better efficiency and reduce overloads on the general legal immigration system.
Historically, premium processing alternatives have been available to those filing Form I-129, Petition for a Nonimmigrant Worker, as well as certain employment-based immigrant visa petitioners filing Form I-140, Immigrant Petition for Alien Workers.
“We recommend expanding premium processing services, giving applicants the option to pay between USD 2,500 to expedite their applications,” the presidential commission said.
The new changes should start applying in 60 days by August 2022 and the authority is expected to follow an approach of implementing premium processing for Immigrant Petition for Alien Workers (Form I-140) in phases introduced gradually. Among those advised were EB-1 Multinational Executive or Manager as well as EB-2 Member of Professions Holding an Ad.
The administration of Joe Biden has also proposed some new changes in visa fees, which include the application fee for the H-1B visa that will increase to $780 from $460, representing a 69 percent increase.
The H-1B visa is a temporary work visa that refers to a Person in Specialty Occupation Visa, which allows employers in the US to hire skilled workers for designated jobs.
