USCIS Completes H-1B Cap Selection Process for FY 2024

The United States Citizenship and Immigration Services (USCIS) has confirmed that the H-1B visa cap for the financial year 2024 has been reached, and all the selected applicants have been informed.

Through a statement, the USCIS announced that it received enough petitions in order for the cap for the FY 2024, beginning October 1, to be reached, including the advanced degree exemption (master’s cap) VisaGuide.World reports.

“We have randomly selected from the registrations properly submitted to reach the cap and have informed all prospective petitioners with selected registrations that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration,” the statement provided by the agency reads.

USCIS has emphasized that the H-1B cap-subject petitions for the financial year 2024, also taking into account petitions eligible for the advanced degree exemption, can be filed with the United States Citizenship and Immigration Services starting from April 1, this year, if following a valid selected registration.

“Only applicants with selected registrations may file H-1B cap-subject petitions for FY 2024, and only for the beneficiary named in the applicable selected registration notice,” the statement reads.

The agency has clarified that registrants’ accounts will now present one of the following statuses for each registration:

Submitted: Meaning that the registration has been submitted and is eligible for selection. In case the initial process has been completed, the registration continues to remain eligible except if subsequently invalidated for selection in any subsequent selections for the financial year for which the application was submitted.
Selected: Selected to file an H-1B ap request.
Denied: This means that registrations are submitted on behalf of or by the same registrant for the same beneficiary.
Invalidated-Failed Payment: This means that the registration was submitted, but the payment method was not disputed or was not reconciled for other similar reasons.

The agency has warned that the H-1B cap-subject petitions should be filed at the correct service center and also within the filing period shown on the relevant registration selection notice.

The US Citizenship and Immigration Services announced that the period for filing the cap-subject petition will be at least 90 days. In addition, it revealed that online filing is not eligible for H1B requests, so petitioners filing H-1B requests must do so by paper. Furthermore, petitioners must include a printed copy of the applicable registration selection notice with the financial year 2024 H-1B cap-subject petition.

The H-1B visa permits highly qualified foreign citizens to temporarily work in the United States by allowing US companies to hire them, thus allowing them to work in specialty occupations that cannot be filled by US citizens.

The United States has set the current annual regular cap for the H-1B category t a total of 65,000.
