Employers from the United States are subject to significant difficulties when looking to employ foreign workers following the low annual limit for approving H-1B visas.
Such a conclusion has been reached in the recent report of the National Foundation for American Policy (NFAP), titled “H1B Petitions and Denial Rates in FY 2022, VisaGuide.World reports.
The report has considered that the only problem with H-1B visas is the low limit of H-1B visas sanctioned in a month.
The visa denial rates for H-1B visas used to remain very high during the Trump administration area, however, the situation changed after the administration’s losses in federal court.
The H-1B also known as a Person in Specialty Visa permits US employers to bring to the US qualified workers engaged in specific fields such as architects, IT specialists, accountants, lawyers, professors, etc.
According to the report, the annual H-1B visa allocations are capped at a total of 85,000, but US employers submitted nearly 4,83,000 H-1B registrations in April last year, according to the figures provided by the United States Citizenship Immigration Services (USCIS).
Of a total of 85,000 H-1B visa allocations made in a year, 20,000 are dedicated to workers holding advanced degrees from United States institutions, while the remaining 65,000 visas are approved on a lottery basis.
It has been reported that the majority of students in US universities are foreigners. According to NFAP about 70 per cent of full-time electrical engineering and computer and information science graduates are internationals.
“Despite the end of the Trump administration’s restrictive immigration policies that made US companies less competitive in the global battle for talent, companies in America still must deal with the low annual limit on H-1B petitions and employment-based green cards,” NFAP’s executive director, Stuart Anderson, pointed out in this regard.
It has been emphasised that internationals contribute significantly to the United States economy. According to a recent study of NFAP about 55 per cent of America’s startup companies valued at $1 billion or more have at least one immigrant founder.
In 2022, Amazon got most of the H-1B petitions approved for initial employment, according to the recent report of NFAP. In addition, it was reported that the company got a total of 6,396 petitions approved last year.
The report provided by Mint, notes that after the majority of tech firms are cutting their workforce by firing their employees, layoff for United States workers can be harder after they are obliged to find another job in the US in order to remain in the H-1B status.
